COMPETENCES
The State Attorneys Office operates:

  • ex lege: on the basis of instructions of guidance, it represents the State, its organs and administrative organs with legal personality, before courts of justice or
  • ex mandato: on the basis of a power of attorney, it represents entities before administrative bodies (the Office must agree to take up such representation).

The Office, at the request of the Government, its organs and administrative bodies

  • reports on cases in which it acts as their representative, and
  • acts as counsel in negotiations of contracts that entail property rights and obligations for these entities, and in negotiations of contracts whereby material rights concerning real estate are either established or abolished, and in instances of solving other property issues. 

In administrative disputes, the State Attorney may also act as an individual party, i.e., a party acting in the public interest. In this , the State Attorney may file an action, a counter-action or apply to be a party to proceedings. He may thus challenge administrative decisions that have become res judicata, whereby a request of an individual has been granted to the detriment of the public interest.


TASKS
The State Attorney’s office is the representative of the Republic of Slovenia and other entities defined in the State Attorney Act (Zakon o državnem pravobranilstvu - ZDPra-UPB2 and ZDPra-C, Official Gazette RS no. 94/2007 and 77/2009) before national, foreign and international courts It acts also as counsel to entities it represents.
