Authorities similar to the State Attorney’s Office have existed in Slovenia since the 15th century. They were first called prokuratura and later fiscal. In the late Yugoslavia before the Second World War, this was a body within the Ministry of Finance, whose key mission was to safeguard the “public treasury”. Today, within the national judicial system the Office strives for the realisation of goals in the field of justice, i.e., the effective, peaceful and civilised settlement of disputes in society. The operation of the State Attorney’s Office is governed by the State Attorney Act (Zakon o državnem pravobranilstvu -ZDPra-UPB2 and ZDPra-C, Official Gazette RS nos. 94/2007 and 77/2009).
The State Attorney's Office represents the Republic of Slovenia and other entities (i.e., the Government , its bodies and administrative organisations with legal personality) before courts of justice and administrative authorities. The Office also represents the Republic of Slovenia before foreign and international courts, such as the European Court of Human Rights and the Court of Justice of the European Union. It also acts as counsel to the entities it represents. The Office may additionally perform tasks defined in other acts (such as negotiating settlements concerning refunds due from investments in the public telecommunications network). It also conducts preliminary proceedings.
The Office is an independent national authority. Resources for its operation are provided by the budget of the Republic of Slovenia.
Organisation of the State Attorney’s Office
The organisation of the Office is regulated by the relevant Act, while the internal organisation is determined by the State Attorney General in agreement with the Minister of Justice in State Attorney’s Rules.
The tasks of the State Attorney’s Office are performed by the State Attorney General, state attorneys and assistant state attorneys. The Minister of Justice, acting on a proposal from the State Attorney General, determines the number of state attorneys and assistant state attorneys.
The State Attorney’s Office performs tasks within its competence at the head office in Ljubljana and at branch offices of the State Attorney’s Office in Celje, Koper, Kranj, Maribor, Murska Sobota, Nova Gorica, Novo mesto and Ptuj.
Appointment
The State Attorney General is appointed by the National Assembly of the Republic of Slovenia on the proposal of the Government of the Republic of Slovenia acting on a recommendation from the Ministry of Justice. The State Attorney General is appointed for a period of six years and may be reappointed.
State attorneys and assistant state attorneys are appointed by the Government of the Republic of Slovenia on the proposal of the Ministry of Justice acting on a recommendation from the State Attorney General. They are appointed for a period of eight years and may be reappointed.
